Terms of Service 

General Info: 

The artist, Daniel Snyders, operates under D. P. Jones Creative Ltd. 

All transactions, communications, and information shared through this website or otherwise are conducted with D. P. Jones Creative Ltd, and not with the artist in his personal capacity. 

D. P. Jones Creative Ltd is a company registered in England and Wales.

- Please note that the registered office address is not monitored for general correspondence. For any inquiries, please contact us using the details shared on our website 

D. P. Jones Creative Ltd is responsible for: 

-Fulfilling orders, handling returns 

-All customer correspondence 

-Addressing any complaints or issues related to purchases (including original paintings, prints, merchandise) 

-Handling complaints regarding the art subjectivity value and/or associated written material (including artist statements, labels, captions, titles, descriptions, social media posts relating to artwork) 

-The company, D. P. Jones Creative Ltd, assumes any liabilities arising from transactions or complaints 

Acceptance of Terms: 

By using our website www.danielsnyders.co.uk, communicating with us and/or purchasing or attempting to purchase any products or services, you agree to these Terms and Conditions. Please read them carefully. If you do not agree, you must not use the Site or purchase products. 

Products, Services & Availability: 

All artworks, prints, merchandise and services are subject to availability. 

We reserve the right to: 

● Limit quantities 

● Withdraw products 

● Refuse or cancel orders where necessary (including pricing errors or payment issues) 

If we cancel your order after payment has been taken, you will receive a full refund. 

Pricing: 

All prices are listed in GBP (£). 

Prices: 

● Include applicable UK taxes where required 

● Exclude delivery charges unless otherwise stated 

The total price (including delivery) will be shown before checkout. We reserve the right to change prices at any time, but this will not affect confirmed orders. 

Ordering Process: 

-Order Confirmation: Once we receive your order, we will aim to acknowledge and begin processing it within two working days. We reserve the right to cancel an order at any time for reasons such as limited stock, unforeseen personal circumstance or issues with payment processing. 

Processing Times 

-Orders are typically processed within 10 working days. -Prints may take up to two weeks where printing, mounting or framing is required. 

Timeframes are estimates only. 

Payments: 

Payments are processed securely through Squarespace Payments and its authorised payment providers. 

We do not store your card details. 

By placing an order, you confirm that: 

● The payment method is yours 

● You are authorised to use it 

We reserve the right to cancel orders where payment is declined or suspected to be fraudulent. 

Shipping & Delivery: 

We currently ship to the UK mainland only. 

If you are outside this area, please contact us before purchasing. 

Delivery & Risk: 

Under UK consumer law, goods remain our responsibility until they are delivered to you. 

If your item is damaged or lost in transit: 

● Please contact us within 48 hours of delivery (or expected delivery date). 

● We may request photographs. 

● We will arrange a replacement or refund where appropriate. 

Your Legal Right to Cancel (Consumer Contracts Regulations 2013): 

If you are purchasing as a consumer online, you have a legal right to cancel your order within 14 days of receiving the goods. 

To exercise your right to cancel: 

● Notify us clearly by email or in writing within 14 days of delivery. 

You must then return the goods within 14 days of notifying us. 

Refunds 

We will: 

● Refund the price paid for the goods 

● Refund the standard delivery cost (if applicable) 

● Issue the refund within 14 days of receiving the returned goods 

Refunds will be made using the original payment method. 

Returns for Faulty Goods 

Under the Consumer Rights Act 2015: 

Goods must be: 

● As described 

● Of satisfactory quality 

● Fit for purpose 

If your item is faulty: 

● Contact us as soon as possible. 

● You may be entitled to repair, replacement or refund depending on timing. 

Nothing in these Terms limits your statutory rights. 

Return Costs 

Unless the item is faulty or misdescribed, you are responsible for return postage costs. A contribution may be offered at the discretion of D. P. Jones Creative Ltd. 

Commission Terms: 

● A discovery meeting will take place online (or in person at our discretion). 

● A written proposal including quotation and timeline will follow. 

● A 50% deposit is required before work begins. 

Either party may withdraw prior to deposit payment. 

Midpoint Review 

At the midpoint review: 

● If the buyer withdraws, 75% of the deposit will be refunded. 

● 25% will be retained to cover time and materials. 

The artist, on behalf of D.P. Jones Creative Ltd, will offer weekly updates via a platform mutually agreed between the buyer and artist. 

Completion steps 

-Once the painting is finished, a semi-final preview will be shared with the buyer. There will then be an opportunity for any further and final tweaks. Note: "tweaks" should not exceed more than 20% of hours spent thus far - i.e. complete changes to composition or changes to themes would not be feasible as part of this stage. 

-Once the final deposit is paid, the final and framed piece will be delivered. This will be via recorded secure shipping or courier. 

Ownership: 

If a commission is cancelled after work has begun: 

● D. P. Jones Creative Ltd retains ownership of the artwork. 

● We reserve the right to sell the artwork or reproduce it unless otherwise agreed in writing 

Bespoke & Commissioned Artwork (Exemption from Cancellation Rights): 

Commissioned artworks are custom-made to your specification. 

Under the Consumer Contracts Regulations 2013, bespoke goods are exempt from the 14-day cancellation right once work has begun. 

By paying the 50% deposit and instructing us to begin work, you acknowledge that: 

  • The statutory cancellation right no longer applies. 

Galleries: 

Where artwork is loaned to a gallery: 

● The gallery is responsible for safe installation and insurance. 

● Works must be returned in original condition. 

● The gallery assumes responsibility for damage occurring while in its possession or control. 

-Gallery insurance should be in place to cover any damage or injury (whether the damage occurs in the gallery setting or during transit). 

-Neither D. P. Jones Creative Ltd, nor the artist Daniel Snyder's can be responsible for any negative public or critical reaction to the artwork and subsequent damage to reputation. 

Copyright & Intellectual Property: 

-All artwork on this Site is owned by D. P. Jones Creative Ltd, unless otherwise stated. By purchasing any art, including originals, prints and merchandise, you are granted a non-exclusive, non-transferable license to display the artwork for personal use only. 

-All artwork, designs, and products sold through D. P. Jones Creative Ltd remains the intellectual property of D. P. Jones Creative Ltd. Purchasing an item does not grant the buyer any rights to the underlying copyrights. I.e. D. P. Jones Creative Ltd may still sell prints of purchased original work unless it is agreed otherwise. 

-You may not reproduce, distribute, modify, or sell the artwork in any form without express written consent from D. P. Jones Creative Ltd. The artwork is protected by copyright laws, and any unauthorized use is prohibited. 

Unless agreed otherwise in writing, we retain copyright in all artworks, including commissioned pieces. 

Limitation of Liability: 

Nothing in these Terms excludes or limits liability for: 

● Death or personal injury caused by negligence 

● Fraud or fraudulent misrepresentation 

● Any liability which cannot be excluded under UK law 

Subject to the above, we are not liable for: 

● Indirect or consequential losses 

● Loss of profit or business 

● Screen colour variations 

Customers are responsible for ensuring artworks are safely installed and hung using appropriate fixings. We assume that sold pictures (or any other products) are handled and hung with care. 

All visual artistic work and associated written material - including artist statements, labels, captions, titles, descriptions - are expressions of an artistic interpretation and honest opinions. Any resemblance to real individuals or their experiences are coincidental. 

Changes: 

We reserve the right to modify these Terms and Conditions at any time without notice. Changes will be posted on this page, and the effective date of the changes will be updated accordingly. By continuing to use the Site after any such changes, you accept the new Terms and Conditions
